Nutella Loses "Healthy" Lawsuit

Slimy gelatinous not-chocolate muck Nutella has lost the class-action lawsuit filed against it for claiming it was a healthy food item. In fact, one serving's ingredients are "comparable to a Three Musketeers bar."
“Defendant’s claims regarding Nutella are also false and misleading because they omit that Nutella contains over 55 percent processed sugar, the consumption of which has been shown to cause type 2 diabetes and other serious health problems,” the suit said. Particularly popular in Europe, especially Italy, Nutella is a breakfast and snack staple. Creative home cooks have been known to use it as a substitute in recipes for chocolate-banana crepes or chocolate thumbprint cookies. Basketball star Kobe Bryant formerly served as the spread’s spokesman. It even has its own fan-started “World Nutella Day.” The chocolate topping is made with sugar, palm oil and hazelnuts. A few tablespoons of Nutella contain about 200 calories, 11 grams of fat (3.5 grams saturated) and 21 grams of sugar.
As part of the massive settlement, Ferraro USA has agreed to compensate American customers for up to the cost of five jars of Nutella ($20). The actual payout will depend on how many people apply.

Next month tens of thousands of Ultra Orthodox Jews will rally in Citi Field, the Queens home of the New York Mets. Their mission is to denounce the modern world, specifically the internet and its supporting devices. The following notice has been published in NYC's Jewish Press:
It is well known that in recent times that through the Internet many serious family-related problems have been created, and it all happens because of it, and something must be done so they won’t be hurt. And since this touches almost everyone, we must assemble together to protect and be protected, and we hope that through this gathering in search of ideas we will be helped from Heaven to save the many, and may it be that we will be successful in encouraging the public not to stumble over this obstacle, and the Lord will guide us in a truthful path. BRITAIN: Vatican Liaison Calls For Ecumenical Battle Against LGBT Rights

The Vatican's official liaison to Britain has called for all religions to put aside their differences in superstitions in order to unite in battle against the civil equality of gay people.
Addressing English and Welsh bishops at their plenary meeting in Leeds, Archbishop Mennini, warned them they faced a “lengthy and probably difficult campaign”. “I wonder if we shouldn’t ask for and look for more support among other Christian confessions and indeed, persons of other faiths,” he said. “It seems to me that, concerning the institution of marriage, and indeed the sanctity of human life, we have much in common with the position of the Jewish community, the Chief Rabbi and many of the more significant representatives of Islam.” Speaking in London yesterday the second most senior active Catholic cleric in England and Wales, Archbishop Peter Smith, of Southwark, said there had been no “formal” contact with Jewish groups to form a united front on the subject of marriage. But he said: “We will work with anyone who agrees with us that to redefine marriage is not a good thing for society and will lead to more confusion.” He criticised the Government’s plans as “dangerous” and lacking in the usual consultation processes required for major legislation.
Before being assigned to Britain, Mennini was the Vatican's representative in Russia, where, according to Wikipedia, he is credited with "dramatically improving" relations with the Russian Orthodox Church. Wanna bet Mennini has a hand in Russia's recent campaign of oppression?

IRELAND: Proposed Bill Will Command Priests To Report Confessed Pedophilia

Ireland is in an uproar over a proposed bill which would make it a crime for priests to withhold crimes of pedophilia revealed in the confession booth.
Irish priests have vowed to defy a new law forcing them to report details of sexual abuse revealed in the confessional box. Ireland’s Justice Minister Alan Shatter is to introduce new legislation which will force the clergy to reveal all details disclosed in confession. But priests have vowed to defy the law despite the threat of a 10-year jail sentence after the introduction of the mandatory reporting legislation. The 800 strong Association of Catholic Priests has even told the Irish Independent newspaper that its members will flout the Shatter law.
Dublin Bishop Raymond Fields: "The seal of the confessional is inviolable as far as I am concerned, and that's the end of the matter." The new penalty for any Irish citizen who withholds knowledge of child abuse, priest or not, would be up to ten years in prison.

How To Win Money From Atheists

At his Tennessee high school's annual Dress Like A Fictional Character Day, one kid showed up as Jesus. Not only was he not expelled, he's been awarded scholarship money from an atheists group.
Jeff Shott, a sophomore at Summit High School, was not disciplined for his action back in January, but Principal Charles Farmer did advise him that if the costume caused a distraction during the day he would have to remove it. Shott voluntarily removed his robes and sash, a costume that included a hammer and nail. But Shott's pluck was not overlooked by the Freedom From Religion Foundation. Annie Laurie Gaylor, co-president of the organization, located in Madison, Wis., said Shott exhibited "spunk and a light touch with his actions." "We wanted to encourage him, and we know the cost of higher education. This is just a small stipend toward that," Gaylor said. Shott is the first to receive the Paul Gaylor Memorial Student Activist scholarship, named for Annie Laurie Gaylor's father, who recently passed away, she said.

Betsy Johnson Shops Go Bankrupt

Iconic Manhattan designer Betsey Johnson's 63-store chain filed for bankruptcy yesterday.
The filing will likely result in the dismissal of 350 employees and the closure of most of the brand’s 63 stores. It listed “severe liquidity problems” and $4.1 million in outstanding unsecured obligations owed to vendors, manufacturers, service providers and other creditors including jewelers, watchmakers, banks and accountants. Steve Madden, who has owned the 34-year-old brand’s intellectual property rights since 2010, said in an email that the group will continue to support the company and ensure existing orders will be produced and ship on time.
Johnson's line will continue to be sold at Sak's and similar high-end retailers.

A reader points out that Daubenmire's son is a registered sex offender convicted of possessing child pornography.
Authorities found 37 still images and 26 movies depicting young girls enaging in sex with men on the family's home computer. A computer repair technician discovered the pornography last August. David Daubenmire is a former head football coach at London High School. He gained national attention in 1999 after the American Civil Liberties Union sued the school district to stop the coach from leading his team in prayer. Zachary Daubenmire was a star quarterback at London. He went on to play football at Kenyon College and Denison University and became a teacher and coach. He has since resigned from those positions.

At the corner of East 72nd and Second Avenue, workers are preparing the site for one of the major stations for the Second Avenue subway. (Rail enthusiasts have chided me for not using the actual name of the line, the T, which I've avoided because that's what Bostonians calls their entire system.) The building that was on that corner was only recently demolished and already I can't recall any of the half-dozen restaurants that lived there. The building on the left is now peppered with new steel braces so that it doesn't fall over into the giant hole.

Grenell’s being openly gay is, in itself, of no consequence for his service in the Romney campaign. Nor is the fact that he supports same-sex marriage — if, that is, we were assured that this view would have no influence on American foreign policy. But Grenell has made a particular crusade of the marriage issue, with a kind of unhinged devotion that suggests a man with questionable judgment. And when the Obama State Department is already moving to elevate the gay-rights agenda to a higher plane than religious freedom in the foreign policy of the United States, it is reasonable to wonder whether Grenell, after taking such a prominent place in the Romney campaign’s foreign-policy shop, would be in line for an influential State posting where he could pursue his passion for that same agenda.

Siberia Bans "Gay Propaganda"

The local legislature in Siberia has become the fourth Russian body to ban "gay propaganda." These laws effectively outlaw gay parades and publications. Bigger than the entire United States by one-third, Siberia is by far the largest region in Russia, comprising 77% of the nation's total area.
"It's mainly about various gay parades... about their promotion among minors. It's about preventing people who are not related to homosexuality from explaining to their kids what is going on," said Alexander Ilushchenko, who oversees a regional committee on culture, education, sports and youth policy. A law penalising "the propaganda of homosexuality and paedophilia among minors" came into force in St. Petersburg on March 17, prompting mixed reactions among Russians where anti-gay sentiment remains strong.
The Russian Orthodox Church is lobbying for a federal version of the ban.

Budweiser Warns Ultimate Fighting Championship About Homophobia

Anheuser-Busch, the primary sponsor of Ultimate Fighting Championship, is chastising the popular mixed martial arts league for anti-gay remarks made by some of its competitors.
"We've communicated to the UFC our displeasure with certain remarks made by some of its fighters, and they have promised to address this. If the incidents continue, we will act," the brewer said in a statement. A-B, which did not elaborate on potential actions, also stated that it "embraces diversity and does not condone insensitive and derogatory comments rooted in ethnicity, race, religion, sexual orientation, gender identity, disability, etc." The rebuke comes as the UFC is gaining mainstream exposure through support from major advertisers and a long-term TV deal with Fox that includes live prime-time matches. In a statement to Ad Age, UFC said: "With over 425 athletes on our roster, there have unfortunately been instances where a couple athletes have made insensitive or inappropriate comments. We don't condone this behavior, and in no way is it reflective of the company or its values."
The National Center on Domestic and Sexual Violence has stated that children should not be exposed to UFC matches due to homophobic and misogynist language.

Will Log Cabin Endorse Romney?

Even with Romney's hiring of an openly gay spokesman, the Washington Blade is wondering if Log Cabin Republicans will withhold their endorsement, as they did with Bush in 2004. Blade reporter Chris Johnson writes:
The debate over whether to endorse Romney could prove thorny for Log Cabin.On one hand, the organization is likely to feel pressure from its Republican base to throw its support behind the party’s standard-bearer in the general election. On the other, Romney has backed anti-gay positions during the primary season, including support for a U.S. constitutional amendment banning same-sex marriage throughout the country and a pledge to defend the Defense of Marriage Act in court.

Christian Berle, Log Cabin’s deputy executive director, said the board will make the endorsement decision in advance of the Republican National Convention in Tampa Bay, Fla., this August. “The endorsement of any candidate is something Log Cabin Republicans takes very seriously, particularly when it comes to a presidential nominee,” Berle said. “Staff and the board of directors will take the next several months to review Gov. Romney’s record and his vision for leading the country. Log Cabin Republicans will maintain its battle focus on building a stronger, more inclusive GOP.”

Has Another "Ex-Gay" Given Up?

You may remember John Paulk as the nationally infamous "ex-gay" activist once touted on the cover of Newsweek as the poster boy and chairman for Exodus International. Paulk was chased out of the organization some time later after activist Wayne Besen accosted him in a DC gay bar, where Paulk claimed he had only dropped in to get directions on how to get away from there. Or something.

This week it was noticed that Paulk, now the owner of a Portland, Oregon catering company, lists himself as "interested in men and women" on his Facebook page, which is littered with Glamor Shots-style images of Paulk and attractive men. Hello. Besen's own organization, Truth Wins Out, was named in response to Love Wins Out, an "ex-gay" advocacy group founded by Paulk. In response to Paulk's Facebook page, yesterday Besen asked: "What would James Dobson say?"

Former Liberia President Charles Taylor Found Guilty Of Crimes Against Humanity

Charles Taylor, the former president of Liberia and the one-time business partner of Pat Robertson, was found guilty today of a long list of war crimes, including crimes against humanity. Taylor faces life in prison.
His trial lasted five years, during which the court heard a catalog of horrific acts committed by rebels whom Taylor helped arm in Sierra Leone’s civil war. The war ended in 2002 after more than a decade of fighting and more than 50,000 deaths. The rebels backed by Taylor became particularly known for hacking off the limbs of their perceived enemies and carving words onto their bodies. They also recruited children to fight and terrorized the civilian population through rape, looting and burning down homes. Crucial to their campaign were the weapons they bought from Taylor and paid for with what came to be known as “conflict" or "blood" diamonds, because of their role in fueling conflict in Africa.
In 2010 prosecutors in the case claimed that Pat Robertson had lobbied the first Bush administration on Taylor's behalf in order to gain the rights to gold mines controlled by Taylor's war lords. Taylor testified that year that Robertson had indeed been his main political ally in the United States. According to pilots that worked for Robertson's Operation Blessings, planes that Robertson told 700 Club viewers were ferrying Christian relief supplies to genocide victims in Rwanda were in fact carrying mining equipment to Liberia.

RELATED: In February of 2012, Taylor's ex-wife, now a member of the Liberian Senate, proposed a death penalty for homosexuality. A weakened version of that bill is still pending.

Mexican Immigration Trend Reverses

For the first time in almost 100 years, more Mexicans are leaving the United States than entering.
A four-decade tidal wave of Mexican immigration to the United States has receded, causing a historic shift in migration patterns as more Mexicans appear to be leaving the United States for Mexico than the other way around, according to a report from the Pew Hispanic Center. It looks to be the first reversal in the trend since the Depression, and experts say that a declining Mexican birthrate and other factors may make it permanent. “I think the massive boom in Mexican immigration is over and I don’t think it will ever return to the numbers we saw in the 1990s and 2000s,” said Douglas Massey, a professor of sociology and public affairs at Princeton University and co-director of the Mexican Migration Project, which has been gathering data on the subject for 30 years.
RELATED: Yesterday the Supreme Court heard arguments on Arizona's SB 1070, which allows police to demand proof of residence for "suspicious" individuals. Early accounts indicate that the Court may uphold at least part of the law.

Kaye, a former chief judge of the state, will officiate; the nearly 300-person guest list includes the mayor, the governor and New York’s two United States senators. The wedding is a personal event for Ms. Quinn, but it is also freighted with political significance, coming just a year before Ms. Quinn is expected to ask New Yorkers to elect her as their mayor.
Quinn will be married by the same former judge who officiated at the wedding of Assemblyman Daniel O'Donnell, the legislator most-credited in the battle to bring same-sex marriage to New York state.

About That Bill To Ban "Ex-Gay" Therapy

I should have pointed it out myself, but Jim Burroway makes the astute observation that California's pending bill to ban "ex-gay" therapy would only apply to licensed mental health professionals. Parents would still be completely free to ship their poor child off to whatever crackpot dirtbag preacher they found on the internet.

Burroway also outlines another way around the pending law:
This is trickier but equally important, and it goes to the very heart of the dishonesty of some of the ex-gay therapists who are licensed. Professional therapists already have a problem in billing insurance companies for their clients who are trying to change their sexual orientation: Insurance companies won’t foot the bill. There is no code in the Diagnostics and Statistical Manual (DSM) for homosexuality, and a code is always required in insurance forms in order to be compensated. So how do those therapists get paid? Easy. As I’ve personally heard a number of ex-gay therapists explain it, their clients are invariably distressed, anxious, depressed, and so forth. And there's a whole smorgasbord of codes for them to chose from.

Civil Unions Pass Colorado Senate

As some had predicted, Colorado's civil unions bill passed in the state Senate today. Now comes the tougher fight in the state House.
Senators approved the measure on an unrecorded voice vote Wednesday after several shared personal experiences to argue in favor of adopting legal protections for all unmarried couples and their children. The Senate will take one more vote before the measure heads to the House, where a similar bill was rejected last year. Colorado voters banned gay marriage through a constitutional amendment in a 2006. However, civil union protections could be enacted without a vote by the people.

Democratic Sen. Pat Steadman, as he has in the past, argued for his civil union bill, speaking from his perspective as a gay man in a committed relationship. Steadman held up thick, heavy books of Colorado law to illustrate how many legal protections are available only to married couples. Steadman argued that boring nuts-and-bolts aspects of Colorado probate law make life unduly complicated for unmarried couples. "Why is this so important?" Steadman asked. "It's because life happens to people. People have babies. People adopt children. People have accidents. People end up in the hospital."
Last year a civil unions bill failed to pass its House subcommittee by one vote. It's not yet known when this year's bill will be considered, but the current legislative session ends very soon.

USMC Boots Teabagger Sergeant For Insubordination To The President

Tea Party folk hero USMC Sgt. Gary Stein has been discharged from the military for public declarations that he would refuse orders from his "unlawful" commander in chief, President Obama.
Brig. Gen. Daniel Yoo announced Wednesday that Stein will be separated from the service under other than honorable conditions. Stein, 26, a Temecula resident, ran afoul of Marine Corps and Pentagon regulations restricting troop political activity by calling for Obama's ouster and making statements that the president was the "enemy" and that he would not follow his orders unless he considered them lawful. Stein, who could not be reached for immediate comment, was informed of the decision Wednesday morning, according to one of his attorneys, Gary Kreep of the United States Justice Foundation. "He is very disappointed," Kreep said. "His grandmother died last night and then this hit him." Stein will now fight for reinstatement through Marine Corps legal channels and continue pressing a court case, Kreep said. Earlier this month, he unsuccessfully sought to persuade a federal court to issue a restraining order or preliminary injunction to stop the separation.
Stein is being backed by the ACLU, who says that his Facebook postings and birther-related political activism falls under freedom of speech protections. The "Patriots For Sgt. Stein" group on Facebook has over 8000 members.

Facebook Deletes Manhunt Fan Page

Manhunt reports that Facebook has deleted their fan page.
We have repeatedly filled out online form after form on Facebook, and sent numerous e-mails to any Facebook address we could find via research to ask for information on why our page was taken down and what we can do to get it restored. We have received a single e-mail back that gave us very little info and in fact asked the recipient of an e-mail that none of us received to get back to them. Replies to that single e-mail have not been responded to.
Do many people still use Manhunt in the age of Grindr, etc?

MINNESOTA: Republican Lawmakers Block Bill To Ban Medicaid For "Ex-Gay" Therapy

A move to stop using Medicaid dollars for programs that "pray the gay away" was defeated along a mostly party line vote in the Senate. Senator Scott Dibble (DFL-Minneapolis) argued that tax payers should't have to pay the bill for "therapies that do real damage to individuals and are based on a particular, narrow religious perspective." Senator Dibble said research shows that changing a person's sexual orientation is not possible.

SAN FRANCISCO: Vehicular Manslaughter Charges For Castro Bicyclist

A bicyclist who reportedly blew through the intersection at Castro and Market streets will be charged with vehicular manslaughter. The 71 year-old man struck in the crosswalk died on the scene. Such a charge for a bicyclist is extremely rare. The case has roiled San Francisco's blogosphere since the April 6th incident.
The last time there was a fatal collision between a bike and a pedestrian the DA charged it as a misdemeanor. A source told the Chronicle that the DA has strong evidence that shows the bicyclist was grossly negligent. The wreck did prompt city officials to promise that there would be stricter enforcement of traffic laws. Part of the evidence the DA's office has is a motorist that saw the bicyclist, Chris Bucchere, blow through some stop signs and red lights before the accident. A conviction of felony vehicular manslaughter is punishable by up to 16 months in jail.
Here in mostly-flat New York City, I've long told friends that if I'm ever killed on the street, it won't be terrorism. It'll be kung pao chicken hurtling the wrong way on my block. Sometimes they're even on the sidewalk.

Activists kicking off action for ACT UP’s 25th Anniversary chained themselves to the entrance to Wall Street’s Stock Exchange just moments before the opening bell this morning. 10 were arrested. AIDS Activists demand a Financial Speculation Tax, a tiny tax on speculative financial transactions that would raise up to $350 billion in the United States annually to fund 15 million people on treatment by 2015 and lead to an eventual end to the AIDS pandemic. The activists had business suits, which allowed them to blend in downtown, but then donned bandit masks and Robin Hood hats. The international campaign for a Financial Speculation Tax has often been called the “Robin Hood Tax Campaign.” “The Financial Speculation Tax Wall Street can afford this extremely tiny tax on the ‘casino economy’ transactions that contributed to the recession. People with AIDS need that money to restore draconian budget cuts to put us on track to end the AIDS pandemic,” said activist Megan Mulholland.
